Rewards Programme Terms
1. About these terms
These terms govern the Divergent Kitchen rewards programme, operated by Divergent Kitchen. They apply together with our Terms of Service and our Privacy Policy.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law.
These terms are written by NexDine, the platform Divergent Kitchen uses to run the programme, and are the same for every venue on it. A venue may add its own terms at the end, but those additions cannot take away anything given to you here.
2. Joining
Membership is free and there is no minimum spend. A rewards account may be opened for you when you order, book or sign up with a mobile number or email address at Divergent Kitchen.
We show you these terms when you sign up, and the next time you sign in after an account has been opened for you, and we record which version you accepted and when.
3. How you earn points
You earn 1 point for every $1 you spend. Points are worked out on the amount you pay for your order. Tips, surcharges and delivery fees do not earn points.
Points appear on your account after the order is paid. A refunded order has its points reversed. Your tier may multiply the points you earn, and the venue may run bonus-point offers. Your tier and its benefits are shown on your rewards page, and every point you earn, including any bonus, appears in your activity there.
4. What points are worth and how to use them
Points are redeemed for the rewards shown on your rewards page, at the points cost shown there. A reward that gives store credit adds that credit to your account when you redeem it.
Points have no cash value. They cannot be sold, transferred or exchanged for cash, and cannot be redeemed against a transaction that has already been paid.
If you do not place an order or dine with us for 18 months, your points balance expires and returns to zero.
The period is measured from your most recent visit, not from the day each point was earned. Any order or booking resets the period in full and keeps your whole balance.
We will remind you before this happens, at about 30, 15 and 7 days before the date, on the mobile number or email address held on your account, and we will tell you afterwards if a balance has expired. If the contact details on your account are out of date we may not be able to reach you, so please keep them current.
Expired points cannot be reinstated or bought back. You can see your balance and activity at any time on your rewards page.
6. Store credit
Store credit is separate from points. It is spent at the counter in the venue and cannot be used for online orders. It cannot be exchanged for cash and it is not a gift card. Leaving the programme does not cancel store credit you already hold.
7. Tiers
The programme may have tiers. The tiers, the points needed for each and the benefits each carries are shown on your rewards page. If your points no longer meet a tier's threshold you may move to a lower tier, any benefit attached to the higher tier ends with it, and we will tell you when that happens.
8. Changes to the programme
We may change the earn rate, the expiry period and these terms, including any additional terms in clause 13. A change that reduces your benefits takes effect at least 30 days after we give you notice of it. That includes a lower earn rate, a shorter expiry period, and any change to the additional terms in clause 13. We will give you at least 30 days' notice of such a change, on the contact details held on your account and on your rewards page, and the notice will say what is changing and the date it takes effect.
A change that only improves your benefits, such as a higher earn rate or a longer expiry period (or no expiry at all), may take effect immediately. It will appear in these terms and on your rewards page from the day it takes effect. If a change improves one benefit and reduces another, the whole change is treated as one that reduces your benefits.
The rewards catalogue — which rewards are offered and how many points each one costs — is shown on your rewards page and may change at any time without notice. Points you have already redeemed are not affected.
If a change shortens the expiry period, the points you hold on the day the change takes effect keep the expiry period they were earned under. The new period applies only to points earned after that day. When you redeem points, your oldest points are used first.
If you do not want to continue under a change that reduces your benefits, you may use your points before the change takes effect, or leave the programme under clause 9.
Any points balance you have is forfeited when you leave, because points have no cash value and there is no other way to settle them. Before you confirm, we tell you how many points you will lose, so you can redeem them first.
Unsubscribing from marketing messages is not leaving the programme. It stops the marketing; your membership and points continue, and so does the expiry period.
10. Suspension and closure
We may suspend or close an account only where we reasonably believe it has been used fraudulently or in serious breach of these terms. We will tell you when we do and why, and you may ask us to review the decision.
11. Your personal information
To run the programme we hold your name, your mobile number or email address, your orders and bookings with us, your points activity and, if you give it to us, your date of birth. When you accept these terms we also record which version you accepted, when, the IP address you accepted from and a one-way hash of your browser's user-agent string, as evidence of your acceptance. We use this to keep your balance, apply your rewards and send you service messages about your points, their expiry and changes to these terms. Service messages are sent whether or not you receive marketing.
We send marketing only where you have agreed to it, and you can opt out at any time. Our Privacy Policy explains who we share information with, how to access or correct it, and how to make a complaint.
